La pandemia no es momento para reformar las postulaciones judiciales en Guatemala

As is the case in many countries across the globe, the COVID-19 pandemic has further undermined the rule of law in Guatemala due to the use of emergency measures to limit fundamental freedoms and blur the separation of powers.
Simultaneously, the ongoing judicial nominations and elections process in Guatemala has been plagued with technical failures and high-level corruption scandals, casting a shadow over the legitimacy of the judiciary and highlighting that reforming the process is vital for the rule of law. Although the judicial nominations process is in sore need of reform, the executive’s recent proposals to do so amidst the COVID-19 pandemic does not allow for the open and transparent process which is needed to bring back legitimacy to and trust in Guatemala’s judiciary.

Como es el caso de muchos países en todo el mundo, la pandemia del COVID-19 ha minado aún más el Estado de derecho en Guatemala debido al uso de medidas urgentes que restringen las libertades fundamentales y opacan la separación de poderes. De forma simultánea, los nombramientos judiciales y procesos de elección que se llevan a cabo en Guatemala se han plagado de fallas técnicas y escándalos de corrupción de alto nivel proyectando una sombra sobre la legitimidad del sistema judicial y haciendo evidente que la reforma del proceso es vital para el Estado de derecho. Aunque el proceso de nominaciones judiciales dolorosamente necesita reformarse, las recientes propuestas del ejecutivo para realizarlo en medio de la pandemia de COVID-19 no permite el proceso abierto y transparente tan necesario para devolver la legitimidad y la confianza en el sistema judicial de Guatemala.
