Judges are increasingly finding themselves on the frontline of defending the rule of law and coming under attack for doing so. The latest report by Dr Diego García-Sayán, the United Nations Special Rapporteur on the independence of judges and lawyers, sheds light on this reality. ILAC has also observed this trend in the contexts where it works to support the justice sector, and this policy brief will discuss examples from the West Bank and Guatemala. If this current trend continues, the rule of law could lose one of its guardians.

Cada vez es más frecuente encontrarse con magistrados en la primera línea a la defensa del Estado de derecho, razón por la cual sufren ataques. El último informe presentado por el Doctor Diego García Sayán, Relator Especial de las Naciones Unidas sobre la independencia de magistrados y abogados, abre un panorama de gran claridad sobre el tema. La ILAC también ha estudiado la tendencia en el contexto dentro de su ámbito de trabajo para apoyar al sector de justicia, y el presente resumen de políticas discutirá ejemplos Cisjordania y Guatemala. Si la tendencia sigue elevándose, es posible que el Estado de derecho pierda a uno de sus guardianes.
